Conditions of use
By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. Rochester Muay Thai only grants use and access of this website, its products, and its services to those who have accepted its terms.
You must be at least 18 (eighteen) years of age before you can use this website. By using this website, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. Rochester Muay Thai assumes no responsibility for liabilities related to age misrepresentation.
You agree that all materials, products, and services provided on this website are the property of Rochester Muay Thai, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute the Rochester Muay Thai’s intellectual property in any way, including electronic, digital, or new trademark registrations.
You grant Rochester Muay Thai a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.
As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address it accordingly.
We reserve all rights to terminate accounts, edit or remove content and cancel orders in their sole discretion.
By visiting this website, you agree that the laws of the state of New York, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Rochester Muay Thai and you, or its business partners and associates.
Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by New York state or federal court and you consent to exclusive jurisdiction and venue of such courts.
You agree to indemnify Rochester Muay Thai and its affiliates and hold Rochester Muay Thai harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on liability
Rochester Muay Thai is not liable for any damages that may occur to you as a result of your misuse of our website.
Rochester Muay Thai reserves the right to edit, modify, and change this Agreement any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Rochester Muay Thai and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
Membership Terms & Conditions
A membership period is defined as one (1) month. Memberships are automatically renewed every month unless cancellation is provided within thirty (30) days of your membership renewal period. Rochester Muay Thai reserves the right to change membership fee schedules at any time.
If, for any reason, you need to stop training, either permanently or temporarily, you understand that it is your responsibility to send an email to email@example.com at least 30-business days prior to your renewal date or 2-business weeks prior to your requested suspension date.
Please make sure you receive a reply from us acknowledging that we received your request.
Membership cancellation and suspension requests must be submitted via email. We do not accept either request in any other form of communication other than email.
Membership Temporary Suspensions
Members may suspend their account once per year. Memberships suspended more than once per year will incur a $50 restart fee. We allow a maximum of two suspensions per year. We do require at least a 3-week suspension of classes for temporary suspension requests and suspensions can be for a maximum of 3 months. Requests must be made at least 2-business weeks prior to requested suspension date.
Requests MUST be submitted via email to firstname.lastname@example.org. Please make sure you receive a reply from us acknowledging that we received your request.
Payments are made at the beginning of the Membership Period. The first month of enrollment will be pro-rated such that subsequent payments are due on the first (1) day of the month. Payment for subsequent periods will extend your membership and implies your continued consent to the terms of this agreement. Membership fees are non-refundable.
Check payments are not an option.
Credit Card Payments
It is the students’ responsibility to insure there is always an active credit card on file for monthly membership payment processing. If your credit card does not process, we will provide a one-time courtesy of a reminder to submit new payment information. If the payment fails a second time, a $25 processing fee will be charged for each month the payment is late. If the credit card fails to process a third time, Rochester Muay Thai reserves the right to cancel your membership after your account is brought current. Please remember to keep your payment information current and accurate so your membership remains in good standing.
You understand that it is your responsibility to make sure your payment is received on-time.
Should your credit card, bank account, or other form of payment change, you will notify Rochester Muay Thai at least 15-days prior to the next billing cycle to avoid a late fee penalty of $25.
Rochester Muay Thai will not send a reminder of any form of payment being due. Your credit card or bank account statement will act as your receipt of payment.
Membership Rates are subject to change. Rate changes will be communicated via the email@example.com email at least 45 days prior to implementation. The rate change becomes effective upon the member renewal date (next payment period) following the 45-day notification.
Buyer’s Right To Cancel
If you wish to cancel this agreement, you may do so by emailing your request to firstname.lastname@example.org within 7-business days of your first class. The notice must say that you no longer wish to be bound by this agreement, and that you would like to cancel your membership. If loaner gear was provided, you must return it or your account will be charged for the full price of the gear. This agreement may also be cancelled if Rochester Muay Thai ceases operation.
A regular class schedule will be posted at rochestermuaythai.com. Rochester Muay Thai reserve the right to make temporary and/or permanent modifications to the schedule at any time, for any reason.
Uniforms, equipment, camps, private lessons, etc. are all additional costs and are not included in with tuition or registration. The Muay Thai program requires hand wraps and boxing gloves. Gear may be purchased through any other supplier. Please ask your instructor for gear requirement guidance.
By choosing a membership plan and signing above, I indicate that I have read and understand the terms of this Membership Agreement, and that I have read and signed a Liability Waiver Form. This agreement, and its information, will remain on file in a secure location, within Rochester Muay Thai office unless the terms and conditions change. At that time, a new contract will be executed.
